Terms and conditions of use



Object

The site, available at https://www.hecalumni.fr/, is a private professional social network made available by HEC Alumni to allow its members (students, graduates) to help each other, to keep in touch, to facilitate networking, to share opportunities, to exchange advice, to enhance the value of training and to promote professional integration, employment and career. The site and its services are provided by the "AlumnForce" application published by MEVIA, a simplified joint stock company with a capital of €11,300, registered in the Nanterre Trade and Companies Register under the number B 501 609 143, whose registered office is located at 93-97 rue Eugène Caron, 92400 Courbevoie, France. The purpose of these general terms of use is to govern access to and use of the Site. We invite you to read them carefully. By activating your Account, requesting an Account, making a reservation for an event or making a purchase on the Site, you acknowledge that you have read and accepted all of these General Conditions of Use.

Definitions

Capitalized terms in the TOS shall have the following meaning (unless otherwise expressly stated):

Website means the HEC Alumni website accessible at https://www.hecalumni.fr/ giving access to the Network Services.

Users means members who can access the services via an Account (students, graduates, teachers, recruiters or representatives of a partner company), individuals registering for an event and Administrators. For each type of User, access to the services may be limited according to the choices made by the Administrators.

Administratorsmeans the natural persons employed or not by HEC Alumni and authorised to use the Modules of the AlumnForce application for professional or management purposes: they have access to an Account allowing them to set up the Modules and to configure or carry out actions on the Users' Accounts.

Account means a valid account giving access to the services of the site.

Content means any content that Users can download and access from the site, including but not limited to articles, events, directories, profile sheets with Personal Data according to the privacy settings that each User has configured in their preferences.

Personal Data means any Personal Data relating to a natural person who is or could be identified.

Modules refers to the management applications of a private professional social network developed by AlumnForce and accessible in "software as a service" (SaaS).

Privacy Policy means the document established by HEC Alumni presenting its processing of Users' Personal Data and defining their corresponding rights.

Services means the supply of the Modules and the additional services that can be provided by AlumnForce at the request of HEC Alumni, such as configuration, assistance or training, etc.

Scope of the General Conditions of Use

The present General Terms of Use ("GTU") are applicable to all use and access to the site's services. They are validated electronically by the User at the time of the activation of his Account and at each modification of the GTU. The GCU are accessible at any time on the Site. The professional social network is not freely accessible. Access is reserved for Users of the network who have accepted the GTC and who have an Account with a login and password.

Users acknowledge that they have read and understood the TOS and agree to be bound by them.

HEC Alumni reserves the right to modify the GCU at any time by notifying by email any new version to the Users, who undertake to take note of these modifications.

Description of the services provided by HEC Alumni

HEC Alumni offers its members the following services such as:

A participatory network information and sharing service (news, events, discussions, newsletters, wall activities, comments, internal messaging, notifications, sharing to social networks, etc.)

A directory of User members with access to User profiles.

A service to put Users in touch with each other via an internal messaging system.

A job offer service.

A service of participatory groups.

A membership subscription service.

An online donation, ticketing, magazine subscription and product purchase service.

A service of good plans, projects and announcements.

A mentoring service

A lifetime email address service in the form of an alias allowing a redirection to the email of your choice.

All these services aim to bring together HEC Alumni members to promote networking, mutual support, professional integration and career development.

Accessing the services

The User of the Website acknowledges having the necessary skills and means to access this Website and having verified that the computer configuration used does not contain any virus and that it is in perfect working order.

In order to benefit from access to the network, the typical HEC Alumni graduate, student or teacher must have an active e-mail address to activate his or her account and participate in the network. His or her account must have been created beforehand by an Administrator.

Anonymous visitors can access the Site, view public articles and events, but cannot visit profiles, post comments or participate in discussions. They may have access to register for events open to the public. In this case, they will have to accept the TOS to reserve their participation in such events and provide at least their first name, last name and an active e-mail.

Users such as recruiters or representatives of a partner company may join the network with restricted access in order to post job offers. These accounts must be validated or created in advance by an Administrator.

The User undertakes not to use a pseudonym or e-mail address that could infringe the rights of third parties (patronymic name, brand name, etc.), nor to usurp a name, a company name or a registered trademark.

At the first connection, the User will have to accept and validate the T&C, specify his password and update his Account preferences with regard to notifications and privacy levels of his profile information. The User's Account may be deactivated and deleted by an Administrator if it remains inactive for more than two years.

Administrators

Administrators declare that they are authorised to use the Services and have accepted the TOS on behalf of the HEC Alumni. The Administrator sets up the configuration of User Accounts via individual imports or additions. He sets up and validates access requests from Users such as representatives of partner companies. The Administrator can send the accesses to each User. The Administrator is able to block access to a User if necessary.

User accounts

The User will be able to access the Services once the GTC have been validated and only if the User's Account has been previously created by an Administrator with at least a first name, a last name and an active e-mail. The User will need to provide at least one active e-mail and specify the password to identify himself at the first connection. The User may modify and update his e-mail and password at any time from the management of his Account. He will then access his User menu to access the different Modules of the platform in accordance with the accesses authorised according to his type of User.

Password

The password associated with each Account is strictly personal and confidential and must not be shared with third parties. Users are responsible for the loss or theft of their password. We recommend that Users regularly change their passwords and choose complex passwords of at least 8 characters comprising letters, numbers and specific characters. Each User is free to change his or her password at any time from the management of his or her Account.

Use of services

The texts, software, images, videos, data and any other work on this site are protected by the intellectual property code. The User of the site agrees not to reproduce them without the express consent of HEC Alumni. The User agrees not to copy or sell all or part of the Modules and the Site.

The User guarantees HEC Alumni that he/she has the necessary rights, including all intellectual property rights on the articles, testimonies, comments, images and data of any kind that he/she discloses on this Website, allowing him/her to grant the rights transmitted herein.

The User expressly agrees, free of charge, that his testimonials and comments may be reproduced and/or represented in the communication media intended for the promotion of HEC Alumni for the entire legal period of protection of his comments and testimonials.

The messages and images posted are under the responsibility of their author who undertakes to assume all responsibilities and consequences thereof. In particular, the author of the message guarantees HEC Alumni against all actions initiated by third parties and having as cause, basis or origin the content of his message. He/she therefore undertakes to pay the amount of the related condemnations and defence costs, or any transactional indemnity that would be due in the context of the dispute. The representatives of the site decline all responsibility for the content of messages posted by users.

The User is responsible for the Account assigned to him/her from the date of activation of the latter. It is his duty to keep his Account secret and not to disclose it to any other person. The User is solely responsible for the Use that is made of his Account, as well as the Content published via his Account.

For the respect and good of all, the following are prohibited: messages of an abusive, offensive, obscene or defamatory nature, content contravening the rights of others, violent comments or incitement to racism, pornography, paedophilia or crimes and misdemeanours, the misuse of the site for propaganda, commercial prospecting or political purposes.

Users may report any disturbing messages to the Administrator. The Administrator may delete without notice any message that does not comply with the above conditions.

HEC Alumni reserves the right, without justification, to refuse access to the Site to any visitor or User who has not respected these terms of use or the applicable law. In the event that, according to the visitor or the User concerned, it would be an error, the latter can contact HEC Alumni.

Club participation

The Site allows Users, if the Clubs/Groups Module is active, to create restricted circles within the network. They can organise themselves into groups, for example around a city or a region or a professional theme. The members of each group can thus have access to articles, events, forums, media and a directory specific to their group. Each group and its members must comply with the provisions of these TOS.

Posting of job offers

All Users of the Site who are able to submit a job offer undertake not to use prohibited or discriminatory criteria, including the following: origin, sex, morals, sexual orientation or identity, age, marital status or pregnancy, genetic characteristics, actual or assumed membership of an ethnic group, nation or race, political opinions, trade union or mutualist activities, religious beliefs, physical appearance, etc. (Art. L 1132-1, L 1142-1, L 5531-2 of the French Labour Code).

Personal data protection and privacy policy

The controller of the personal data referred to herein is HEC Alumni.

The data processors are the companies MEVIA and Oakland.

The data, initially integrated, concerning the Users in the Site come from HEC Alumni. These data are necessary to obtain an Account and access to services. It includes at least the first name, last name, e-mail and academic background.

The other data is updated optionally by the Users themselves from their profile in order to present their expertise and projects to other Users for the purpose of interacting and creating exchange opportunities, matchmaking, and generating statistics on professional mobility:

- Profile picture
- Presentation
- Personal details (telephone, mobile, personal e-mail(s), main and secondary addresses), date of birth, married name, family status
- Current job and professional details (position, typical job function, company, typical sector, e-mail)
- Previous job(s))
- Current situation and professional wishes
- Skills acquired and languages used
- Additional training
- Community activities and interests
- Curriculum vitae (via uploaded file or generated using the above information)

The identity of Users is only publicly visible if the User has activated their public profile or Public CV. Each User is free to activate or deactivate their public profile at any time.

The identity of Users (First Name, Last Name, Photo, City, Country, Position, Company) is visible to other Users from the Directory (list and map view) and from any interaction on the professional social network through an activity or participation by the User in an article, event, comment, group or discussion.

Information collected from Network Users through their profile and form can only be viewed by other Network Users: (students, graduates, authorised recruiters, Administrators). Users can restrict access to their profile information according to the type of User via their privacy management.

Users who are Recruiters or representatives of a partner company provide the following data for the creation of an Account:

- Title, First name, Last name, E-mail, Position in the company
- Company's name and address

External visitors to the network who register for an event will be required to provide at least the following data:

- First name, Last name, E-mail

And depending on certain events, the following data:

- Address, Telephone, Mobile, Date of birth, Current position, Company, Business address, Business e-mail

When paying for a service on the Site (such as an event ticket, membership fee, donation or subscription), we will ask you to provide shipping and billing address information in order to create an order and associated receipt. We do not store any banking data, this information is processed by our online payment processing provider SRIPE.

When you use the Site, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the proper performance of the agreement between you and us, for us to comply with legal obligations and in view of our legitimate interest in being able to provide and improve the functionality of the Site:

- Geolocation Information: When you use certain features of the Site, we may collect information about your location, either through your IP address or through the GPS of your mobile device, in order to provide you with a better User experience. Most mobile devices allow you to control or disable the use of location-based services in applications from the device settings menu.
- Usage Information: We collect information about your interactions on the Site, such as page views, content views, searches, purchases and other actions on the Site in order to improve the Site Services.
- Login and Device Data: We automatically collect login and device data when you access the Site. This information includes, but is not limited to: information about how you used the Site, IP address, access dates and times, computer hardware and software data, device data, device usage data, unique identifiers, crash data, cookies. This information allows us to improve the performance of the Site and the quality of the Services and to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.

Users agree to always provide truthful and accurate Personal Information and to update or approve the updating of such information as necessary to keep it complete and accurate. We will regularly ask you to do so.

A User's information contained in the professional network database remains the property of that User. In accordance with the European regulations in force, the Users of the Site have the following rights:

- the right of access (Article 15 GDPR) and rectification (Article 16 GDPR)
- the right to erase Users' personal data (Article 17 GDPR)
- the right to withdraw consent at any time (Article 13-2c GDPR)
- the right to limit the processing of Users' data (Article 18 GDPR)
- the right to object to the processing of Users' data (Article 21 GDPR)
- the right to portability of data provided by Users (Article 20 GDPR)

Any user of the network can freely modify or delete the information they have entered on the network. They can also demand that information about them provided by HEC Alumni be corrected, completed, clarified, updated or deleted. No personal information is put online without the knowledge of the network members.

By modifying your information from the management of your Account, in the "My Profile" section.

HEC Alumni is the only one authorised to hold the data and undertakes not to resell it or pass it on to third parties other than subcontractors operating on behalf of HEC Alumni, and to ensure that this information is not processed for any other purpose than being put on line within the Site. HEC Alumni is likely to process your Personal Data in the context of your access and/or use of the Website as well as the updating of the information put online. This includes data collected by HEC Alumni when a User activates his/her Account or updates information on the User's profile.

Duration of data retention

We will only store your data for as long as is necessary for the purposes for which it was collected, in accordance with legal requirements.

Security

The User of the Website acknowledges being informed of the risks associated with the use of the Internet and networks, and in particular the fact that information relating to personal data can be copied or intercepted. The User of the Website acknowledges that he/she accepts these risks, for which HEC Alumni can in no way be held responsible. HEC Alumni implements all the technical and human resources to ensure a permanent level of security in accordance with the rules of the art in this field and to prevent attacks from malicious persons. Some of the safeguards we use to protect your information are firewalls and encrypted data transmission using SSL/HTTPS technology.

Intellectual property on the website

The HEC Alumni website is protected by the provisions of the French Intellectual Property Code, in particular on the protection of databases. Any person who creates a file or a database with the information on the HEC Alumni website, and who makes it available to a third party, for a fee or free of charge, without the agreement of HEC Alumni and in violation of the GTC, will be subject to civil and/or criminal penalties as provided for by the Intellectual Property Code.

Changes to the privacy policy

HEC Alumni reserves the right to change this Privacy Policy in order to comply with changes in applicable laws and regulations. Any changes will be notified via our Website or by e-mail, if possible, at least thirty days before they come into force.

Warranties

HEC Alumni undertakes to take particular care regarding the accuracy of the information exchanged on the Site and to keep it regularly updated. However, errors or omissions may be found. In this case, we would be grateful if you could inform us so that we can make the necessary corrections. During its verifications and occasional interventions, the Site Administrator undertakes not to modify the Contents in a way that could change their meaning. However, he reserves the right to move Content if he notices a flagrant error of thematic classification.

HEC Alumni does not guarantee uninterrupted access to the Site, especially in case of maintenance, repairs, or disruptions of Internet connections. It cannot be held responsible for technical failures and related data loss, or for any other indirect damage occurring during or related to the use of the site.

Applicable law

The GTU is governed solely by French law. Any dispute relating to the validity, interpretation and/or execution, termination, of these GTU and after failure of any conciliation, will be submitted to the Commercial Court of Paris.
